  1. Booking / booking confirmation

    1. The reservation of the holiday apartment is final with the signature of the rental contract and after the deposit has been paid.

    2. The tenant is obliged to check the booking data for accuracy. If the rental agreement deviates from the booking request and the tenant does not raise objections immediately, the content of the rental agreement is deemed to have been contractually agreed.

    3. The tenant is obliged to provide truthful information about the number of people occupying the holiday home. The holiday apartment may only be used by the persons listed in the booking. If the apartment is used by more people than agreed, a separate fee must be paid for them, which is determined in the rental price. In this case, the landlord also has the right to terminate the rental agreement without notice. Subletting and letting the apartment to third parties is not permitted. The rental agreement may not be passed on to third parties.

    4. Bringing pets is only permitted with the approval of the landlord after prior agreement. A cleaning fee of EUR 50.00 applies per pet and stay. If animals are accommodated without the prior consent of the landlord, the landlord can charge a flat-rate cleaning fee of up to EUR 200.00 (net).

  2. Payment terms

    1. A deposit of 25% is due immediately after signing the rental agreement. The remaining payment is due three weeks before arrival at the latest. For short-term bookings with three weeks' lead time or less, the entire amount is due immediately upon booking.

    2. The tenant bears all costs of payment, especially in the case of transfers from abroad. Only payments by bank transfer to the bank account communicated by the landlord are accepted. Other means of payment are only accepted after prior agreement.

    3. A deposit of EUR 150.00 is due with the payments. The landlord will reimburse this deposit if the holiday home is vacated on time and all keys are returned, to an account specified by the tenant no later than three days after the day of departure, unless otherwise agreed with the tenant, and provided that the holiday home has no damage for which the tenant is responsible.

    4. If the tenant is in default of payment by more than 3 days, the landlord is entitled to terminate the contract without notice and to rent the rental property to someone else. No further written notice is required. There is no entitlement to a refund of the deposit.

  3. Rental object and keys

    1. The apartment is fully furnished and equipped and includes bed linen, towels and tea towels.

    2. The apartment is a non-smoking property. Smoking is only permitted outside. In the event of non-compliance, the landlord can charge a cleaning fee of up to EUR 200.00 (net).

    3. The tenant receives two house keys for the duration of the rental period. If one or both keys are lost, a fee of EUR 150.00 (net) is due.

  4. Arrival and departure

    1. The apartment is available from 3 p.m. on the day of arrival. Arrival must be before 6:00 p.m. Arrival outside of these times can only take place if this has been expressly agreed with the landlord in advance.

    2. On the day of departure, the tenant must leave the apartment by 11:00 a.m. at the latest. A departure after 11:00 a.m. can only take place if this has been expressly agreed with the landlord in advance.

    3. The apartment must be left swept clean on the day of departure. The dishes, glasses, etc. must be cleaned. Furthermore, the garbage cans must be emptied and the refrigerator cleared out.

    4. The keys are handed over on arrival and departure in consultation with the landlord on site.

    5. The guest is obliged to show the landlord their valid identity card or passport upon arrival.

  5. Cancellation and termination of stay

    1. If the tenant cancels (terminates) the contract before the start of the rental period, the following pro-rata amounts must be paid as a cancellation fee:

      • up to 30 days before the start of the rental period: free cancellation possible;

      • 14 to 30 days before the start of the rental: 50% of the rental price;

      • less than 14 days before the start of the rental: 100% of the rental price

    2. A cancellation can only be made in writing. The day of receipt of the declaration by the landlord is decisive (by 12:00 noon).

    3. If the tenant terminates his stay prematurely, there is no right to a refund.

  6. Cancellation by the landlord

    1. In the event of a cancellation by the landlord, as a result of force majeure or other unforeseeable circumstances (such as an accident or illness of the host) or other circumstances for which he is not responsible and which make fulfillment impossible, the liability is limited to the reimbursement of the costs. In the event of a justified withdrawal, the tenant has no right to compensation. Liability for travel and hotel costs is not accepted.

  7. Liability and obligations of the tenant

    1. The apartment is handed over by the landlord in a neat and clean condition with complete inventory. Should there be any defects or should any defects occur during the rental period, the landlord must be informed immediately. The tenant is liable for any damage caused to the rental property, the inventory and the communal facilities, e.g. broken dishes, damage to the floor or furniture. This also includes the costs for lost keys (locking system).

    2. The inventory is to be treated with care and must remain in the holiday apartments. The tenant is also liable for the negligence of his fellow travelers. Damage caused by force majeure is excluded from this. The contract can be terminated without notice if the holiday home is used in breach of the contract, such as subletting, overcrowding, disruption of housekeeping etc., as well as failure to pay the full rental price. The rent already paid remains with the landlord.

    3. If there is liability insurance, the damage must be reported to the insurance company. The landlord must be informed of the name and address as well as the insurance number of the insurance company.

    4. If the terms and conditions or the house rules are violated, the landlord is entitled to terminate the rental relationship immediately and without notice. There is no legal right to repayment of the rent or compensation.

    5. The landlord has the right to access the holiday home at any time, especially in the case of imminent danger. Appropriate consideration must be given to the tenant's interests worthy of protection when exercising the right of access. The landlord will inform the tenant in advance about the exercise of the right of access, unless this is unreasonable or impossible for him in the circumstances of the individual case.

  8. Internet usage

    1. Use of the internet is free of charge. The access data will be provided in the apartment. Criminal acts (in particular illegal downloads, page views) will be reported and prosecuted. The tenant is solely liable for unlawful use of the internet.

    2. The provision of the Internet is a free additional service. If it is temporarily unavailable for technical reasons, this is not a defect and does not entitle the tenant to reduce the rent.

  9. Privacy

    1. The landlord will not pass on the personal data provided by the tenant to third parties, unless this is necessary for the execution of the contract.

  10. Written form, severability clause

    1. Changes and additions to this contract must be in writing. This also applies to changes to the written form clause.

    2. Should individual provisions of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, this shall not affect the validity of the rest of the contract. In place of the ineffective or unenforceable provisions, an effective and enforceable provision should be used whose effects come as close as possible to the economic objective of the original provision.

    3. This contract is subject to the laws of the Federal Republic of Germany. The general place of jurisdiction is Munich.
